Appointed by an EPC Sub-Contractor to the EPC Main Contractor on major on-shore gas facility in the Middle East.

We researched and compiled ten substantial claims submissions, incorporating the recurring issue of design claims (FEED errors), government clearance delays, escalating costs, variations, mitigation and loss and expense.

The EPC Contractor mounted a robust and technically skilled defence, coupled with hard-nosed negotiation tactics.

We advised our client against conduct that would have been outside the subcontract and instead strategised and advised an approach that we then helped to implement. Our strategy made it very important for the EPC Main Contractor to actively engage and settle legitimate claims for a mutually agreed sum to an accelerated settlement timeline. Any residual claims (those occurring after this initial settlement) were settled within the defect liability period and the Sub-Contractor and Main Contractor have maintained commercial relationships and are now actively working together on many other projects, notwithstanding a claims settlement of over US$50 million and in excess of 30% of the original sub-contract sum.
